CONTEST RULES & ELIGIBILITY REQUIREMENTS

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE IN OR WIN THIS CONTEST. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. THIS CONTEST IS VOID WHERE PROHIBITED BY LAW.

Agreement to Official Rules.

Participation in the “AMA Insurance GLOBAL HEALTH CHALLENGE” (the “Contest”) constitutes entrant’s full and unconditional agreement to and acceptance of these Rules (“Rules”) and the decisions of AMA Insurance Agency, Inc. (“Sponsor”), Quantum Communications (“Administrator”), and AMA Insurance, International Medical Group, Timmy Global Health, and the Med Plus Advantage Program (collectively, “Supporters”), which are FINAL AND BINDING in all respects. Each entrant acknowledges that the entrant satisfies all eligibility requirements and the entrant believes that each member of entrant’s team satisfies all eligibility requirements. THE OFFICIAL RULES ARE SUBJECT TO CHANGE WITHOUT NOTICE. Winning a prize is contingent upon fulfilling all requirements set forth herein.

Eligibility.

The Contest is open only to eligible teams. Teams will consist of not less than two (2) and not more than five (5) individuals meeting all the eligibility requirements. Each team member must be a legal resident of the 50 United States or the District of Columbia who, at the time of entry, is age 18 or older and is (a) enrolled as an undergraduate student at an accredited four-year college or university in the United States majoring or concentrating in pre-medical studies or having an intention to attend medical school after graduation, (b) a medical student or medical resident eligible for membership in the American Medical Association, or (c) enrolled as an undergraduate or graduate allied health student in an accredited health sciences program at a college or university in the United States.

The Contest is not open to entry where prohibited or restricted by law and is not open to employees or to immediate family members (spouses, domestic partners, parents, grandparents, siblings, children and grandchildren) of employees of the Administrator or Sponsor or any of their respective affiliates or advertising or promotion agencies. For purposes of these Rules an affiliate of, or entity affiliated with, a specified entity shall mean an entity that directly, or indirectly through one or more intermediaries, controls or is controlled by, or is under common control with, the entity specified. The Contest is subject to all applicable federal, state and local laws and regulations. Each team member collecting a prize must meet Timmy Global Health’s requirements for participation in the Timmy Global Health trip, including but not limited to (a) execution of a release of liability in favor of the Sponsor, Administrator, Timmy Global Health, Inc., and all of their affiliates including the Sponsor’s affiliate American Medical Association, (b) meeting all health requirements, and (c) holding a valid passport.

How to Enter.

The entry period for the Contest will begin on 11:00 am CT November 15, 2019 and end at 11:59 p.m. CT on December 5, 2019 (“Entry Period”). An eligible team may enter the Contest at ghc.amainsure.com (the “Site”). When using the Internet, remember that Internet access and usage charges imposed by your online service will apply. Through on-screen instructions, each team will be asked to provide the information required for entry, which will include submission of an original essay of 500 words or less (the “Essay”). Individuals may enter the Contest only once; an individual may not participate on more than one team. Neither the Administrator, nor the Sponsor, nor any of their affiliates, including the American Medical Association, is responsible for incorrect or inaccurate information, human error, technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect or failures of any computer equipment or software or any combination thereof or for any lost, stolen, late, misdirected, incomplete or damaged submission or any submission not submitted during the Entry Period. The Site’s database clock will be the official timekeeper.

Selection of Finalists.

Within three (3) weeks after the end of the Entry Period, judges selected by the Sponsor and Administrator will choose up to ten (10) teams as finalists (“Team Finalists”). Team Finalists will be notified by phone and/or email. Team Finalists will be selected based on such factors as may be deemed relevant in the sole discretion of the Sponsor, Administrator, and the judges, which may include (but are not limited to) the content and quality of a team’s Essay and their educational, professional and/or personal background. As part of the process of selecting Team Finalists, team members of a prospective Team Finalist may be contacted to verify their eligibility to participate in the Contest. If any team member of a prospective Team Finalist fails to provide information deemed by the Sponsor and Administrator to be sufficient to verify such prospective team member’s eligibility to participate in the Contest, the Sponsor and Administrator may, in their sole discretion, disqualify such team member of a prospective Team Finalist from the Contest. A team member’s disqualification may, in the sole discretion of the Sponsor and Administrator, disqualify the remaining team members of a prospective Team Finalist.

Selection of Winners.

After the Team Finalists are selected and notified, each Team Finalist will have five (5) weeks to submit a video (“Video”) that complies with the guidelines provided by the Sponsor or Administrator. Guidelines to be followed by Team Finalists are in the sole discretion of the Sponsor and Administrator, and will require in addition to other requirements, that no person under 18 participates in the Video, that a written release approved or provided by the Administrator is signed by any person appearing in the Video, and the Video background does not violate any law including copyright laws.  Each team member of a Team Finalist shall execute an affidavit of eligibility, assignment of all rights including copyright and release/waiver form provided by Administrator prior to further consideration of the Video and participation in the Contest. The Videos may then be posted at the sole discretion of the Sponsor and Administrator to the Site and, for a period of seventeen (17) days (the “Voting Period”), the public will be permitted to vote for their favorite Video. Videos may be removed from the Site at the sole discretion of the Sponsor and Administrator.  Following the end of the Voting Period, one (1) winning team of the Contest will be selected from the five (5) videos receiving the greatest number of votes, by judges (who may or may not be the same judges that selected the Team Finalists) based on such factors as may be deemed relevant in the sole discretion of the Sponsor, Administrator and the judges, which may include the public response to the Videos. Judges will be selected by the Sponsor and Administrator.  The winning team (“Winner”) will be selected within ten (10) business days following the end of the Voting Period, and the Winner will be notified social media and/or e-mail within thirty (30) days following selection. Sponsor and Administrator may in their sole discretion change the time frames for the Contest noted above.

Prizes.

Each member of the winning team will receive a prize package which is not divisible that consists of the following: (a) the opportunity to spend two to three weeks working with Timmy Global Health teams and partner organizations in the Dominican Republic, Ecuador or Guatemala, including transportation, meals, tips and lodging, and upon embarking for the Dominican Republic, Ecuador or Guatemala with a Timmy Global Health team (“Trip”), (b) a personal blog account through which the winning team can share their experiences working with Timmy Global Health. Team members may or may not have the opportunity to travel together. The total approximate retail value of each prize package is $3,000. All travel arrangements are subject to Timmy Global Health’s, Sponsor’s and Administrator’s approval, in their sole discretion. ALL PRIZES WILL BE AWARDED “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Claiming Prize.

Team members of the Winner who fail to indicate that they will be claiming the prize package within five (5) business days after notification, or if a team member of the winning team does not meet the eligibility criteria, that person may be disqualified and another entrant may be selected as a winner. As all team members of the Winner must be legal residents of the United States, each team member of the Winner will be required to submit his or her social security number or taxpayer ID number in order to claim the prize, and one or more IRS Form 1099 will be filed with the Internal Revenue Service, as required, for the fair market value of the prizes. If any team member of an entrant selected as a Winner fails to provide proof of identity or any required documentation or information, is found to have violated these Rules, or otherwise does not meet applicable eligibility criteria or have violated these Rules, or otherwise does not meet applicable eligibility criteria or Timmy Global Health’s standard requirements for participation in a trip, the entrant’s prize will be forfeited and an alternate winner may be selected.

Prize Restrictions.

Prizes will be awarded, provided a sufficient number of eligible entries are received. Prizes are not transferable and are not divisible; no substitutions or cash equivalents are allowed. Airline carrier’s regulations and conditions apply. Travel may not qualify for frequent flyer miles. Winners must possess valid travel documents in order to travel. All other expenses and costs not expressly listed above, including but not limited to taxes and transportation between the airport and home residence, are the team member’s sole responsibility.

Rights to Submissions.

All entries and materials submitted by an entrant, team member, Team Finalist, or Winner including but not limited to all Essays, Videos, and blog entries (collectively, the “Materials”), become the property of the Sponsor and will not be returned. By submitting any Materials, including any Essay and/or Video and/or blog entry, each entrant, team member, Team Finalist, or Winner assigns to the Sponsor all right, title and interest including but not limited to copyright therein and thereto. Each entrant, team member, and team, represents and warrants that any and all Materials submitted are original and do not infringe upon the copyright or any other right or interest of any other person or organization. Since each entrant is conveying ownership to all Materials submitted to the Sponsor, the Sponsor will have a perpetual, irrevocable, exclusive right to use the Materials or any portion thereof, without restriction of any kind, or permission or notification, to entrant, team member, team, or any third party. As the owner of the Materials, the Sponsor will enjoy the irrevocable right to prepare derivative works, combine the Materials with other works, distribute copies, display, and exploit all rights therein, in the name of the Sponsor or its designees throughout the universe in perpetuity in any and all media now or hereafter known. Each team member of any Team Finalist shall execute an affidavit of eligibility and assignment of all rights including copyright and release/waiver form provided by Sponsor or Administrator.

Use of Personal Information.

By participating in the Contest, each entrant, team member, and team consents to the use of his or her name, city and state of residence, other biographical information, voice and likeness in any manner and in any medium for promotional, advertising and public relations purposes by the Sponsor, without additional compensation, except where prohibited by law.

Disputes.

Except where prohibited by law, each entrant, team member, and team agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with the Contest or any prize awarded including but not limited to the Trip, shall be resolved individually, without resort to any form of litigation including class action, and exclusively by a single impartial arbitrator pursuant to proceedings administered by the American Arbitration Association (AAA) under its rules for resolution of commercial disputes. If the parties are unable to agree upon an impartial arbitrator within thirty (30) days of either party requesting arbitration, either party may apply to the AAA to make the appointment. The impartial arbitrator shall be an attorney or retired judge and admitted to practice in Illinois. The arbitration shall be held in Chicago, Illinois. All submissions to the arbitrator, the proceedings and the award shall be confidential. The parties express their desire that the arbitration be conducted on an expedited basis with minimal discovery. The award shall be in writing and set forth the factual and legal basis for the award. The parties renounce recourse to litigation, to the extent provided by law, and intend the award to be final and binding except that judgment with respect to the award may be entered in any court having jurisdiction over the parties or their assets if the award remains unsatisfied after thirty days. All reasonable costs of both parties, as determined by the arbitrator, including but not limited to reasonable attorneys’ fees necessary to confirm the award in court or to enforce the award, shall be borne entirely by the non-prevailing party, to be designated by the arbitrator in the award, and may not be allocated between the parties by the arbitrator. Each entrant, team member, and team waives any and all objections to arbitration and jurisdiction and hereby irrevocably submits to the venue of those courts within the State of Illinois.

Additional Terms.

To the maximum extent permitted by applicable law, the Sponsor reserves the right to change these Rules or cancel the Contest at any time. In addition, to the maximum extent permitted by applicable law, the Sponsor reserves the right to modify, terminate, or suspend the Contest should viruses, worms, bugs, unauthorized human intervention or other causes beyond their control corrupt or impair the administration, security or fairness of the Contest. Neither the Sponsor, nor the Administrator, nor any of their affiliates, including the American Medical Association, is responsible for any human or other error that may occur in the administration of the Contest. The Sponsor reserves the right, in its sole discretion, to disqualify any individual and his/her teammates from the Contest found to be tampering with the participation process or the operation of the Contest, to be acting in violation of these Rules or applicable law, or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person.

Blogs.

Part of the prize includes the Winner receiving a personal blog account through which the Winner can share their experiences working with Timmy Global Health. The Sponsor further reserves the right, in its sole discretion, to refuse to post any blog posting that it finds offensive, it determines is a violation of these Rules or applicable law or a person’s right to privacy, or whose content is presented in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. Winning team members will also comply with such additional rules in connection with the blog as provided by Sponsor and Administrator.

Indemnification.

By entering the Contest, each entrant, team member, and team agrees (for himself or herself and his or her heirs) to indemnify, defend and hold harmless, the Sponsor, the Administrator, Timmy Global Health, Inc, any Supporter of the Contest including specifically the American Medical Association, and all of their respective affiliates, and the owners, employees, officers, directors, trustees, members, managers, agents, successors, and assigns of each of the foregoing from and against all claims, losses, liabilities, damages, costs and expenses of any kind arising out of or in connection with the entrant’s participation in the Contest or the Trip or the delivery, misdelivery, acceptance, possession, use of or inability to use or to participate in any prize (including, without limitation, claims, losses, liabilities, damages, costs and expenses related to personal injuries, death, and damage to or destruction of property, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory, to the maximum extent permitted by applicable law. Each team member of any Team Finalist shall execute an affidavit of eligibility, assignment of all rights including copyright and release/waiver form provided by Sponsor or Administrator.

Representations.

By entering the Contest, each entrant represents and warrants that (a) the information contained in the Materials is accurate, complete, and represents the entrant’s team’s original work and does not violate the rights of any third party, (b) if a winner, each entrant and team member will make a good faith effort to travel with a Timmy Global Health Team to the Dominican Republic, Ecuador or Guatemala, (c) if a winner, each team will make a good faith effort to complete at least two blog entries regarding travel with the Timmy Global Health Team, (d) each team member will promptly provide to the Sponsor and Administrator all information reasonable requested, and (e) each entrant has read these Rules, understands and is familiar with them, and that, if necessary, a teammate sought independent legal advice.

Winner’s Name.

To obtain the names of the team members of the Winner for the Contest, available after the date of the prize award, send an email to MPA@qtheagency.com with the subject “AMA Insurance Global Health Challenge – Prize Recipient List”. The Sponsor or Administrator will also announce the winning team for the Contest on social media and on the Site. Except as otherwise required by law, the identity of each team member of the Winner will be available for at least thirty (30) calendar days following the date of the prize award. Requests received more than thirty (30) calendar days following the date of the prize award will not be honored.

Privacy Notice.

All information submitted in connection with the Contest will be treated in accordance with these Rules. Prior to submission, any information on the Site will be treated in accordance with the Site Privacy Policy. By participating in the Contest, each entrant acknowledges that each team member has agreed to such privacy policy and consents to the collection, use and disclosure of team members’ personal information for the purposes of administering the Contest and as otherwise permitted herein in accordance with such privacy policy and Rules.  Without limiting the foregoing, by entering the Contest, each entrant grants the Sponsor permission to share the personally identifiable information of each team member with the Administrator, Timmy Global Heath, Inc. and affiliates of Sponsor, Administrator and Timmy Global Health, Inc.

This contest is in no way offered, sponsored or administered by Timmy Global Health, Inc. Timmy Global Health Inc. is pleased to be providing the Trip for this contest.

Sponsor.

The Sponsor of the Contest is AMA Insurance Agency, Inc., 330 North Wabash Ave., Suite 39300, Chicago, IL 60611. The decisions of the Sponsor and/or the Administrator are final and binding with respect to all matters relating to the Contest.

Administrator.

The Administrator of the Contest is Quantum Communications, 1201 Story Ave., Suite 123, Louisville, KY 40206.

Supporters.
